Napier Port updates regulations and conditions
We’re introducing a number of changes, as part of our commitment to make sure everyone who comes to Napier Port goes home safely to their families every day.
We have just updated our regulations and standard conditions of service to reflect requirements under the Health and Safety at Work Act 2015. Key changes include:
Napier Port Regulations
Under the Safety and Access section of our regulations, we have changed sub-clause 7.2 (b). This now reads:
“The User will, in all work undertaken by the User within Port premises or affecting others in Port premises, comply with the Health and Safety at Work Act 2015 and associated regulations.”

Napier Port Standard Conditions of Service
We’ve added a new clause under Part D – General Terms and Conditions. This clause (15) states that:
“The User undertakes that it will comply with its health and safety obligations arising under the Health and Safety at Work Act 2015 and associated regulations.”
We have made a couple of changes to Part E – Responsibility. Clause 1 now reads:
“The Operator will not be liable or responsible to the User for any Claim or Loss arising directly or indirectly by reason of any:-“
We also added a new sub-clause under Clause 1 (g), which reads:
“Intentional or unintentional act or omission by another port User,”
